Carrick Sydney Course Dispute
April 6, 2009
Carrick Institute of Education (Carrick) and the Department of Immigration and Citizenship
(DIAC) have recently resolved a dispute relating to the Carrick Advanced Diploma in
Hospitality Management - 046961D (89 weeks CRICOS) and its graduates who would like to
apply for permanent residency (PR).
The dispute was centered on the definition of a two year academic requirement under DIAC’s
policies for PR and affected those students in NSW only.
The Advanced Diploma of Hospitality Management - 046961D (89 week CRICOS) has been
registered since 2003 with Vocational Education and Training Accreditation Board (VETAB)
the NSW State accreditation body and has always been a ‘two year course’.
A High Court application made by a Carrick student against DIAC has now been settled
successfully in favour of the student.
By settling the matter DIAC have conceded that the student who had completed the
Advanced Diploma of Hospitality Management – 046961D (89 week CRICOS) in Carrick’s
Sydney campus, was considered to have met the two year academic study requirement.
Following ongoing discussions with DIAC, we have now received written confirmation from
DIAC that as a result of this settlement with the Carrick student, DIAC will treat all other
Carrick students who completed the same course, i.e. the Advanced Diploma of Hospitality
Management - 046961D (89 week CRICOS) as if they had satisfied the two year academic
study requirement.
DIAC have advised that the course will only be accepted providing all matters relating to the
course are equal to that of the applicant who applied to the High Court.
Carrick has confirmed with DIAC that it will recommence processing Carrick student’s
applications and Carrick understands this information has been forwarded to the DIAC
processing centre’s to recommence processing PR applications accordingly.
Carrick has maintained a staunch position on this matter throughout its discussions and
communications with DIAC and other government departments.
Carrick is thrilled at this positive outcome for its students enrolled in the Advanced Diploma of
Hospitality Management - 046961D within its Sydney campus.
